Enerzijds brengen overheidsinstanties structureel schade toe aan mensen op de vlucht, zonder dat dit leidt tot strafrechtelijke aansprakelijkheid. Anderzijds is sprake van een voortdurende uitbreiding van het gebruik van het strafrecht tegen actoren die ongeautoriseerde migratie faciliteren, waaronder mensensmokkelaars, migranten en solidariteitsactoren, ook wanneer hun handelen weinig of geen aantoonbare schade veroorzaakt. Het strafrecht wordt daarmee selectief toegepast: het wordt ruim ingezet tegen bepaalde actoren, terwijl het ten aanzien van andere actoren juist buiten toepassing blijft. Het verklaren van deze selectiviteit vormt de centrale doelstelling van dit proefschrift. Het onderzoek gaat van conceptuele theorievorming over naar empirische analyse. Daarbij dienen de externe EU-grenzen van Kroati\u00eb als primaire casestudie, waarna de bevindingen worden geplaatst in de bredere context van de Europese Unie. De centrale onderzoeksvraag luidt: Wat is de rol van criminalisering bij het beheersen van ongeautoriseerde migratie aan de externe EU-grenzen van Kroati\u00eb, bezien vanuit de theorie, de rechtsleer en de juridische praktijk?\n\nHoofdstuk 1 plaatst deze onderzoeksvraag binnen het relevante wetenschappelijke debat en licht de methodologische benadering toe. Vervolgens ontwikkelt hoofdstuk 2 een nieuwe theoretische stelling, voortbouwend op drie overlappende stromingen in de literatuur: crimmigratie, strafrechtstheorie en kritische criminologie. Hierbij staat het concept van strafrechtelijke selectiviteit centraal, dat uitgaat van de gedachte dat het strafrecht niet neutraal of uniform wordt toegepast, maar strategisch wordt ingezet ter behartiging van specifieke belangen.\n\nBinnen de context van migratiebeheersing manifesteert deze selectiviteit zich in twee nauw met elkaar verbonden vormen. De eerste vorm betreft de overcriminalisering van gedrag dat ongeautoriseerde migratie faciliteert, waarbij personen die anderen helpen een grens ongeautoriseerd over te steken, strafrechtelijk worden vervolgd. De tweede vorm ziet op de ondercriminalisering van migratiecontrole, waarbij staatsactoren worden afgeschermd van strafrechtelijke aansprakelijkheid voor de schade die zij tijdens grenshandhaving veroorzaken. Beide vormen dienen uiteindelijk dezelfde afschrikkingslogica. Met deze tweeledige benadering levert dit proefschrift een bijdrage aan de crimmigratieliteratuur, die zich tot nu toe voornamelijk heeft gericht op de uitbreiding van strafrechtelijke bevoegdheden binnen migratiecontrole, terwijl de afwezigheid van strafrechtelijke aansprakelijkheid voor schadelijk overheidsoptreden grotendeels buiten beschouwing is gebleven.\n\nDeze theoretische stelling wordt hierna empirisch onderbouwd; in hoofdstuk 3 wordt daarbij het geografische gebied van de casestudie ge\u00efntroduceerd: de grenzen van Kroati\u00eb met Servi\u00eb en Bosni\u00eb-Herzegovina. Daarbij staan twee praktijken centraal. De eerste betreft het faciliteren van ongeautoriseerde grensoverschrijdingen, ook aangeduid als mensensmokkel of \u2018the game\u2019. De tweede betreft de onrechtmatige collectieve uitzettingen, beter bekend als pushbacks, die door de Kroatische politie worden uitgevoerd. Deze twee praktijken vormen het uitgangspunt voor de daaropvolgende juridische analyse.\n\nDe juridische analyse vangt in hoofdstuk 4 aan met een analyse van de pushbacks vanuit het perspectief van het Kroatische strafrecht. Op basis van 263 getuigenissen van grensgeweld, verzameld door ngo\u2019s in The Black Book of Pushbacks, verricht dit hoofdstuk de eerste systematische doctrinaire analyse van deze praktijken. Elke getuigenis wordt getoetst aan het Kroatische Wetboek van Strafrecht om vast te stellen of en welke strafbare feiten mogelijk zijn gepleegd. Daarbij wordt tevens onderzocht in hoeverre juridische begrippen die verband houden met de rechtmatige uitoefening van staatsgezag, zoals rechtvaardigingsgronden, strafrechtelijke aansprakelijkheid in de weg kunnen staan. Deze taxonomische analyse brengt een breed spectrum aan mogelijke strafbare feiten aan het licht die door Kroatische politieagenten stelselmatig lijken te zijn gepleegd tegen mensen op de vlucht. Daarmee levert het hoofdstuk niet alleen een bijdrage aan de wetenschappelijke literatuur, waarin schadelijke praktijken van migratiebeheersing zelden vanuit strafrechtelijk perspectief worden onderzocht, maar biedt het tevens een analytisch kader voor praktijkjuristen die zich bezighouden met de bestrijding van straffeloosheid aan de Europese buitengrenzen.\n\nDeze analyse wordt in hoofdstuk 5 aangevuld met een onderzoek naar het recht in de praktijk. Op basis van participerende observatie en ongeveer dertig semigestructureerde interviews, afgenomen tijdens etnografisch veldwerk in Kroati\u00eb, Servi\u00eb en Bosni\u00eb en Herzegovina in 2023, laat het hoofdstuk zien dat strafrechtelijke en bestuursrechtelijke aansprakelijkheid voor pushbacks nagenoeg ontbreekt, ondanks een tiental aangiften van lokale ngo\u2019s en advocaten en diverse toezichtprocedures. De bevindingen tonen aan dat overheidsinstanties in de praktijk grotendeels buiten het bereik blijven van het strafrecht dat van toepassing wordt geacht (in hoofdstuk 4). Daarmee wordt een fundamentele lacune in de handhaving van het strafrecht zichtbaar.\n\nIn hoofdstuk 6 verschuift de aandacht vervolgens naar gedragingen die ongeautoriseerde migratie mogelijk maken. Hier keert het eerder geschetste patroon zich om. Praktijken die ongeautoriseerde grensoverschrijdingen faciliteren, evenals uitingen van solidariteit met mensen op de vlucht, worden op uiteenlopende wijzen gecriminaliseerd. Dit gebeurt niet alleen door middel van strafrechtelijke en bestuursrechtelijke sancties, maar ook via informele mechanismen, zoals lastercampagnes en ge\u00efntensiveerd politieoptreden. Het gevolg is een geleidelijke inperking van het maatschappelijke debat en publieke ruimte voor solidariteitsactoren. In de Kroatische context bevestigt dit de verwevenheid van het strafrecht en migratie die in de crimmigratieliteratuur reeds uitvoerig is beschreven. Gezamenlijk bevestigen de bevindingen uit hoofdstukken 4 tot en met 6 de centrale stelling van het proefschrift: dat het strafrecht binnen de Kroatische migratiebeheersing selectief wordt toegepast.\n\nVervolgens worden deze bevindingen veralgemeniseerd naar de bredere Europese context. Hoofdstuk 7 laat zien dat de geconstateerde dynamiek in Kroati\u00eb niet op zichzelf staat, maar deel uitmaakt van een breder patroon binnen de Europese Unie. Ook aan de grenzen van Griekenland, Itali\u00eb, Hongarije, Spanje en Polen zijn de pushbacks en andere schadelijke vormen van grenshandhaving uitvoerig gedocumenteerd. Een verkennende analyse van de strafwetgeving in deze landen wijst bovendien op breed strafbaar overheidshandelen. Evenals in Kroati\u00eb blijkt ook daar dat strafrechtelijke aansprakelijkheid van staatsactoren in de praktijk grotendeels afwezig is.\n\nHoofdstuk 8 breidt deze analyse uit door zich te richten op de criminalisering van gedragingen die ongeautoriseerde migratie faciliteren. Ook hier blijken de in Kroati\u00eb vastgestelde patronen zich in andere lidstaten voor te doen. Het hoofdstuk betoogt dat deze ontwikkelingen mede hun oorsprong vinden in de wijze waarop ongeautoriseerde migratie op het niveau van de Europese Unie discursief wordt geconstrueerd. Op basis van een analyse van ongeveer dertig EU-beleidsdocumenten wordt aangetoond dat EU-instellingen ongeautoriseerde migratie en het faciliteren daarvan consequent framen als georganiseerde criminaliteit en een veiligheidsdreiging, terwijl het mogelijke strafrechtelijke karakter van pushbacks en andere vormen van grensgeweld systematisch buiten beeld blijft.\n\nAlles bijeen laat het proefschrift zien dat strafrechtelijke selectiviteit geen incidenteel of context gebonden verschijnsel is, maar een structureel kenmerk van de Europese migratiebeheersing. Het strafrecht wordt stelselmatig ingezet tegen bepaalde actoren, terwijl anderen in de praktijk grotendeels aan strafrechtelijke aansprakelijkheid ontkomen. Hoofdstuk 9 sluit af met een reflectie op de betekenis van deze bevindingen voor de aansprakelijkheid van staten, de rol van het strafrecht \u2013 in samenhang met het bestuursrecht en de mensenrechten \u2013 bij de begrenzing van uitvoerende macht en voor wetenschappelijk onderzoek naar de relatie tussen het strafrecht en migratie. Daarmee overstijgt het proefschrift de Kroatische casestudy en werpt het bredere vragen op over de juridische, politieke en ideologische fundamenten van het Europese grensbeleid, evenals over de normatieve uitgangspunten die bepalen wie bescherming geniet en wie daarvan wordt uitgesloten.","summary":"At the heart of this thesis lies a consistent and deeply asymmetrical pattern in European migration control: the coexistence of systemic harm inflicted by state authorities on people on the move \u2013 harm that largely escapes criminal accountability \u2013 alongside the expansion of penal responses against those who enable unauthorized migration, such as mobility brokers, migrants themselves, and solidarity actors, even where their conduct causes little or no harm. Criminal justice, in other words, operates selectively \u2013 expansively against some, withheld from others. Understanding this selectivity is the central concern of this thesis. To pursue it, the thesis moves from conceptual theorization to empirical scrutiny, taking Croatia\u2019s external EU borders as its primary case study before generalizing the findings to the broader European Union. The guiding research question thereby is: What is the role of criminalization in controlling unauthorized migration at Croatia\u2019s external EU borders \u2013 in theory, doctrine, and legal practice?\n\nThe thesis opens, in chapter 1, by situating this question within the field and setting out the methodological approach that guides the inquiry. This foundation then enables the development of a novel theoretical claim in chapter 2, which mainly draws on three intersecting bodies of literature: crimmigration (a field studying the entanglement of criminal and migration law), criminal legal theory, and critical criminology. The chapter thereby essentially draws on the concept of criminal selectivity \u2013 the idea that criminal law is not applied uniformly but rather strategically in the service of particular interests.\n\nIn the context of migration control, this selectivity takes two interrelated forms: the over-criminalization of migration-enabling conduct, targeting those who help people cross borders without authorization, and the under-criminalization of migration controlling practices, shielding state actors from accountability for the harms they inflict during border management. Crucially, both forms serve the same deterrent logic. This dual understanding of criminal justice\u2019s selective role represents a significant contribution to crimmigration scholarship, which has traditionally focused on the expansion of penal norms into migration governance while neglecting the equally consequential absence of criminal responsibility on the other side.\n\nThis theoretical claim is empirically substantiated next, for which chapter 3 intro duces the case study\u2019s geographic terrain: Croatia\u2019s borders with Serbia and Bosnia Herzegovina. It identifies two sets of practices that together characterize the realities of migration and its control at these borders. The first comprises the facilitation of unauthorized border crossings, commonly referred to as human smuggling or \u2018the game\u2019. The second consists of unlawful collective expulsions \u2013 known as pushbacks \u2013 carried out by the Croatian police. Together, these practices form the twin objects of the case study\u2019s subsequent legal analysis: one concerned with enabling unauthorized movement, the other with controlling it.\n\nThe legal analysis begins, in chapter 4, by examining the latter practice \u2013 in the form of pushbacks \u2013 through Croatian criminal law. Based on 263 testimonies of border violence documented in the NGO-produced Black Book of Pushbacks, the chapter undertakes the first doctrinal analysis of its kind: each account is coded against the Croatian penal code to identify possible criminal offenses, while also accounting for legal doctrines \u2013 such as provisions on the lawful exercise of state authority \u2013 that might shield such conduct from criminal qualification. The result of this taxonomic classification is a wide range of possible offenses that appear to be systematically committed by Croatian police officers against people on the move. These findings are highly relevant not only for academic scholarship, where harmful migration control practices are rarely studied through penal frameworks, but also for practitioners dedicated to fighting the impunity at Europe\u2019s borders.\n\nThis examination of the law \u2018in the books\u2019 is then complemented in chapter 5 with an analysis of the law \u2018in action\u2019. Drawing on participant observation and approximately 30 semi-structured interviews conducted during ethnographic fieldwork in Croatia, Serbia, and Bosnia-Herzegovina in 2023, it becomes clear that despite a dozen criminal complaints filed by local NGOs and lawyers, as well as various public oversight procedures, criminal and administrative accountability for pushbacks is virtually absent. State authorities, it emerges, remain effectively beyond the reach of the very criminal law the preceding chapter applied to their conduct, exposing a profound criminalization gap.\n\nThe focus then shifts, in chapter 6, to migration-enabling conduct \u2013 and here the pattern reverses entirely. Practices procuring unauthorized border crossings, as well as acts of solidarity with people on the move, are expansively criminalized, not only through formal criminal or administrative sanctions but also through informal mea sures such as smear campaigns and heightened policing that fall short of initiating legal proceedings. The effect is a shrinking of civic space for those acting in solidarity with migrants \u2013 confirming, for the Croatian context, the traditional crime-migration nexus that crimmigration scholars have long identified elsewhere. Altogether, the case study thus confirms across the three respective chapters that criminal justice operates selectively in Croatia\u2019s migration context.\n\nIn a final step, these findings are generalized beyond the case study, finding that the examined dynamics are not uniquely Croatian but embedded in EU-wide patterns. Chapter 7 points to a similar criminalization gap for migration-controlling practices across the EU: Pushbacks and other harmful bordering practice are likewise widely documented at Greek, Italian, Hungarian, Spanish, and Polish borders, and a pre liminary review of these countries\u2019 penal codes reveals various grounds to suspect widespread criminal state conduct. However, similar to Croatia, these contexts also mirror widespread absences of criminal accountability for the respective state actors.\n\nChapter 8 completes this generalization of the case study\u2019s findings by turning to migration-enabling practices across the same countries. Here too, the patterns observed in Croatia find their counterparts elsewhere \u2013 and their roots, the chapter argues, lie in selectively criminalizing policy discourses at the Union level. Drawing on approximately 30 EU policy documents, it shows that Union institutions consistently frame unauthorized migration and its facilitation in terms of organized crime and security threats, while the criminal nature of pushbacks and other forms of border violence remains systematically obscured.\n\nTaken together, the thesis demonstrates that criminal selectivity is not an incidental or locally specific phenomenon but a structural feature of EU migration control. What emerges is a troubling picture: a legal order that deploys criminal law extensively against some, while extending effective impunity to others \u2013 and does so systematically. Chapter 9 offers a final reflection on what this means for state accountability, for the capacity of criminal law \u2013 in connection with administrative and human rights law \u2013 to constrain executive power, and for academic scholarship on the crime-migration nexus.
